BMW Wins Trademark Case Against Local Chinese Firms

(Photo : Getty Images) A Shanghai Intellectual Property Court has ordered Deguo Baoma Group and Chuangjia Group to compensate BMW for trademark infringement.

The Shanghai Intellectual Property Court has reportedly ordered two Chinese firms to financially compensate German auto giant BMW in a trademark infringement case.

The two companies, namely, Deguo Baoma Group and Chuangjia Group, have been ordered to pay 3 million yuan (around $432,000) in fine to the German automaker.

According to Shanghai Daily, the court concluded that the "BMN" logo registered by Deguo Baoma's founder has a very uncanny resemblance to the famous BMW logo. It also took a critical note of Deguo Baoma Group's literal English translation that exactly translates as German BMW Group (Int'l) Holdings.

Talking about the other firm, the newspaper said that the court observed that fashion house, Chuangjia, also imitated the BMW logo and illegally used the logo on its range of fashion products such as clothes, shoes, and bags.

The two accused firms blatantly infringed on BMW's famous trademark to take advantage of German company's unflinching reputation in China, the court added.

BMW's trademark victory comes barely a week after China's Supreme Court favored former basketball superstar Michael Jordan in another trademark infringement case. The case was filed by Jordan in 2012 against a local sports firm that was accused of using the athlete' Chinese name without seeking his due permission.       

Analysts said that these successive wins are setting a new precedence that will give confidence to big firms in filing copy infringement cases against local Chinese companies.

China globally is dodged with reputation of making fake things as well as poor standard products out of globally recognized brands.
