14-Year-Old Special Needs Student Sodomized In Boys' Bathroom By Classmate After Being Used As 'Rape Bait' By Teacher

A 14-year-old female special needs student was reportedly sodomized by a classmate after she was convinced by a teacher to act as 'rape bait'.

In an attempt to catch the alleged 16-year-old sexual predator at Sparkman Middle School, faculty members believed that he had to be 'caught in the act'.

Hence, when the 14-year-old special needs student sought the help of June Simpson, a teacher's aide in the said school, after the alleged sexual aggressor repeatedly harassed her to have sexual relations with him, the school formulated a plan aimed at finally gathering evidence to expel the boy.

According to Ronnie Blair, the school's principal, the boy could not be punished as they had no conclusive evidence despite several reports submitted to his office regarding the sexual aggression exerted by the suspect to some of his female classmates. In fact, the 16-year-old was claimed to have had sexual relations with one of his female victims. The increasing number of reports involving the suspect forcing some of his female classmates to have sex with him in bathrooms allegedly prompted the faculty members to come up with a plan to put an end to the boy's reign of sexual terror.

According to the 14-year-old victim, she initially refused to take part of the sting operation due to her fear of the boy's capacity to cause her harm. However, Simpson repeatedly reassured her that no danger would come her way as the teachers concocted a foolproof plan to save her before anything bad took place.

Legal documents show that the teacher's aide urged the special needs student "to meet (the boy) in the bathroom where teachers could be positioned to 'catch him in the act' before anything happened." After being convinced by Simpson, the victim finally relented to the plan. She then went to the 16-year-old suspect and "agreed to meet for sex".  

The reported plan of the school began to crumble when the boy changed the venue of the supposed sexual tryst with the victim. Instead of meeting her in the usual place, which was the boys' bathroom located along the corridor of the special needs section, he told the 14-year-old to meet him in the bathroom of the sixth-grade boys. This was located at another area of the campus.

Police records reveal that "no teachers were in the bathroom to intervene" when the 14-year-old was attacked.

"She stalled for time. She continually tried to fight him off but ultimately was anally raped by this young man," Eric Artip, the lawyer representing the victim and her parents, stated. A medical examination of the victim revealed that the evidence of trauma "consistent with (the girl) being sodomized" was found.  

"The idea she consented to this and somehow allowed it to happen is incredible," Artip further commented.

Upon arrest, the 16-year-old suspect claimed nothing further than kissing happened between him and the victim. He received a five-day suspension from the school, and eventually went back to attend classes. Prior to the alleged rape, the boy had been reported for 15 forceful or sex-related incidents.  

This incident, which occurred in 2010, was brought to the attention of the public when the 14-year-old's family decided to file a lawsuit against the Madison County School Board.

A federal court rejected the claims of the family, which involved pointing out the violation of the school district with respect to responding to such concerns in a school under its control.

However, an amicus brief was filed on Wednesday by the Department of Justice and U.S. Department of Education, which stated the support of the agencies to the federal lawsuit against the school board. Both agencies confirmed the family's claim that Madison County School Board failed to adhere to Title IX of federal law, which indicates the manner by which schools must react to sexual harassment issues.

In their brief, the agencies stated that the school committed a violation of the aforementioned law when the faculty members decided to use the 14-year-old victim as 'rape bait'. In addition, the brief indicated that the "school administrators knew the student's extensive history of sexual and violent misconduct and were alerted to the substantial risk he posed."

To date, no legal decision had been reached.
