A judge ruled that CBS should pay US$10.4 million to the family of the security guard who was killed during a freak accident on the "NCIS" set in Santa Clarita, California.

The ruling was released on Tuesday.

52-year old Julio Villamariona was the security guard on duty when a driver of a CBS production 15-passenger van lost control and hit him. The said van was carrying members of the cast and crew of the television series, "NCIS".

The accident occured in February 9, 2011.

The driver, Ralph Blunt, was said to have passed out behind the wheel, while Villamariona died in the ambulance en route to the hospital.

His widow and three children then filed a lawsuit against the network.

Brian Panish, the lawyer of the Villamarionas confirmed the ruling, but so far, CBS has not released an official statement regarding the case.

Initially, Panish sought US$30 million in damages, but the lawyer for CBS, Dana Alden Fox, stated that although damages were in order, $2 million was more than fair.

"The size of the verdict is a testament to what a great father and husband Julio Villamariona was. I am amazed CBS would fight this case all the way through trial when they admitted their employee killed an innocent person," Panish stated.

The Villamarionas filed the lawsuit against CBS and Blunt in 2012.

Before the trial began, both parties agreed that Blunt was negligent and that the victim's family should receive US450,000 in lost wages.

Julio Villamariona, who had lost his left eye to a tumor when he was only four years old, was a native of El Salvador. His wife and daughter were the first members of the family to have left El Salvador and move to the United States.

When all of the members of the family finally reunited, Julio Villamariona's daughter shared that he "was very excited he finally had all of the family together."
