Oscar-winning actress Halle Berry is said to be fed up with her former partner Gabriel Aubry's claim that the child support she has been giving him is simply for their 6-year old daughter Nahla. Berry claims that Aubry is unemployed and living off of the US$16,000 a month she has been required to pay in child support.

Berry has been paying her former model-partner US$16,000 monthly since June.

Aside from the monthly child support, a Los Angeles judge required the 47-year old actress to pay a retroactive amount of US$115,000 and an additional US$300,000 for Aubry's attorney fees.

The court had given the said figures based on each parent's total income which is comprised of their wages, bonuses, rental income, commissions, tips and others.

The actress was deemed the primary breadwinner because she earns "substantially more money" than her former partner.

Berry recently filed court documents, asking a judge to reduce the US$16,000 to US$3,000, saying that they have joint custody of their daughter and that Aubry is abusing the system even though he shouldn't have a hard time looking for work.

However, Radar Online reported that the Canadian model has vowed that he won't be giving up without a fight. He stated that the child support was a means to provide a good life for their daughter.

According to a source close to Aubry, "There is no proof that Gabe is abusing the system! He does still do modeling jobs. But it's hard for him to pursue full-time work because he has joint custody of Nahla. There have been numerous modeling gigs Gabe has turned down simply because of the travel involved."

The insider also added that Aubry's focus continues to be his daughter and, that he has good lawyers working on the case.

Berry and Aubry dated for two years and split in 2010.
