The said suit was filed by the family of Sarah Jones, the flick's camera assistant, who died during the filming of the movie.
Lawsuits against director Randall Miller, producer Jody Savin, executive producer Jay Sedrish and first assistant director Hillary Schwartz will push through. The mentioned parties are facing charges of criminal trespass and involuntary manslaughter. All of them have pled not guilty.
The trial for those who still have pending cases is scheduled to proceed in March 2015.
The four accused have been pinpointed by the family as having ignored to implement the safety standards on the set, thus leading to Jones being struck by an oncoming train while the rest of the crew were setting up equipment on train tracks in Wayne County near Savannah, Georgia. The said incident occurred in February.
The team did not have permission to set up equipment and, shoot on the tracks.
A civil lawsuit was filed last May, submitted by Richard and Elizabeth Jones, parents of the deceased production staffer. The said suit named Allman among other names. However, after an investigation was instigated, it was determined that Allman, Lehman, along with some others were not involved in the decision which led to Jones' demise.
"During a very difficult and trying time for our family, Gregg Allman and Michael Lehman demonstrated their genuine sorrow over the loss of our daughter and their willingness to work with us in the future to ensure safe film sets for all. For that, we are grateful," Richard Jones wrote in a statement released to the press.
