SM Ent Takes Legal Action Against KanS for Using Lu Han's Photos without Copyright Approval

KanS, a Chinese cosmetic brand in China has reportedly prompted SM Entertainment to take legal action after they used photos of Lu Han which were taken when he was still actively participating in promotions with South Korean-Chinese band EXO.
SM Entertainment is hot on the heels of a Chinese cosmetic company called KanS after the company released an ad poster which featured several photos of EXO's former member Lu Han. Said photos are claimed by SM Entertainment to have been taken when Lu was still a member of the band.

According to media reports, the photo the 24-year old singer holding a heart was from an ad campaign they were doing for a luxury brand, MCM. On the other hand, the photo which was used for the pillow in the poster is said to have been taken when he was still promoting with EXO-M, the Chinese language sub-unit of EXO.
The representatives of SM Entertainment has released a statement, explaining that they have gathered data about the photos and found out that the copyright belonged to the company.
The company has also expressed that they will be taking legal action against the company which they have accused of an alleged act of copyright infringement.
A Korean media outlet has also reported that the cosmetic company has failed to go through the standard practice of checking the copyrights of the photos before they were used for commercial purposes.
Furthermore, another media outlet cited that if companies wish to use commercials, photos, posters and other materials which are artist-affiliated, should seek for the approval of the rights owner.
The representatives of the cosmetic brand are yet to respond to the issue.
On the other hand, Lu is slated to attend a court-mandated mediation session with SM Entertainment, following the lawsuit he has filed last October.
