Chinese Actor Huang Xiaoming Files a Lawsuit Against Beijing Hospital for Using Nude Photo

Chinese actor Huang Xiaoming just slapped a Beijing hospital a lawsuit for using one of his photographs (in which he appeared to be nude by the way) in a promotional magazine without his consent.

In a formal statement released by the actor himself, he disapproved of the hospital using a photo of himself for the purpose of promoting the hospital's wide range of medical treatments including circumcision. The photo, he said, was obviously used with the intent of selling commercial services since the magazine included their corporation name, the medical services they provide, as well as their contact information.

In his statement, he continued to complain about the hospital by making it clear that not only did they break the copyright violation but they also could have tarnished Xiaoming's reputation since the use of the nude photo implicitly suggests that he endorses or have undergone circumcision, as well as other medical procedures listed in the magazine.

For damage control, the actor requested the hospital to stop issuing the promotional magazines, as well as recall and destroy them. In addition to that, he asked for a public apology to be published in a worldwide newspaper and 300,000 RMB (approximately US$50,000) as compensation.

The photograph, which caused Xiaoming to file a lawsuit is a photoshopped "nude" photo of the actor, in which his face was simply pasted on the naked body of a well-endowed foreign male. A lot of netizens believed that Xiaoming was simply denying that it was him in the photo, but it was later on proved that the photo has indeed been edited. 

According to Huang Bin, the actor's manager, Xiaoming was simply protecting himself by exercising his legal right. Xiaoming, who backed up his manager also told the public " to learn to use the law to protect yourselves."
