Lee and Kim's appeal hearing was held on March 5, Thursday. The model and the former girl group member tearfully apologized to the 'Red 2' actor and his family. Both admitted to the crimes they have committed and referred to their actions as 'foolish'.
After having spent six months in jail, Kim and Lee posted bail on March 9, Monday, and have since been released.
On Thursday, March 26, the court has given its response to the two females' appeal and announced their decision to annul the initial ruling.
According to the judge, the court has decided in Lee and Kim's favor due to different, factors, one of them being the fact that Byung Hun also had his faults. It has been proven that the actor made sexual jokes towards the defendants.
Furthermore, despite seeing himself as the victim in the case, Byung Hun submitted a statement to the court which contained his request for Kim and Lee to be pardoned. The court also stated that the crime has only been attempted and not carried out.
The court also cited that the two defendants appear to have reflected upon their deeds for the past six months that they have served time. In addition, Lee and Kim are said to be first-time offenders.
Both females are still currently facing their original prison sentence, however, it has been suspended for two years. They will remain under probation until then. Media reports say that if their behavior is deemed acceptable by the court for the next two years, they may not have to go to jail.
