Nick Loeb has reportedly filed a lawsuit against his ex-fiancée, Sofia Vergara, so she would not be able to destroy their frozen embryos.
The 39-year old businessman claims that he and Sofia, who previously admitted that she might have a hard time getting pregnant naturally after she successfully battled thyroid cancer, decided to create and freeze two cryopreserved female embryos using her eggs and his sperm so they can use them for In Vitro Fertilization (IVF), months before they decided to part ways in May of last year and now wants to keep the embryos because he believes that "life starts at conception."

As reported by In Touch magazine, the court documents were said to be filed, April 1, by Nick under "John Doe" in California and are seeking to make sure that the female embryos are not destroyed, however, "Jane Doe," (referring to Sofia) "refuses to agree to their preservation under all circumstances."
The magazine also claims that Nick and the "Wild Card" actress hired a surrogate to implant the embryos in and carry the baby, though the procedure sadly failed.
A source close to the situation shared that Nick has wanted to become a dad ever since, which has encouraged him to do whatever he needs to do to save the remaining embryos. The source, who revealed that Nick is pro-life, also said that he is extremely emotionally-invested in the embryos because he strongly believes that "life starts at conception."
Aside from Sofia, Nick has also decided to take legal action against the medical facility where the female embryos are currently being stored, saying that they never determined what should happen in the event that he and Sofia break up.
The legal documents also claim that the Colombian-American beauty, who just got engaged in December of last year to Joe Manganiello and who has a son, Manolo, 23 from a former marriage, "was mentally and physically abusive" to the entrepreneur on several occasions during the course of their relationship.
Though Nick filed the lawsuit against Sofia last August, he recently re-filed just this month and added more information.
Meanwhile, Sofia and her fiancé, Joe, have openly admitted that they want to have children, though she thinks that it will be kind of weird because of the resulting age difference between the baby and her son, who's already 23 years old. However, she said that Joe really wants to have a baby, and if it's going to make him super-happy, then..," the actress added.
