Herbalife CFO To File Lawsuit Against Bill Ackman

John DeSimone, Herbalife's CFO, said the company is planning to sue Perishing Capital Square head Bill Ackman after the latter accused the company of pyramid scheming.
Ackman just finished delivering the "presentation of his life" on Tuesday at the AXA Equitable Building in Manhattan, New York, and presented data that he claimed will prove Herbalife is a pyramid scam.

Ackman focused on the nutrition clubs of its members and how these clubs violate labor laws by not paying its workers.
After the backlash, DeSimone spoke with Stephanie Ruhle from Bloomberg TV. Ruhle asked the CFO if they are planning to sue Ackman for his slanderous claims and he said the company is contemplating on doing such.
"We may. That's on the table. It's an option. I think our case gets stronger every day," DeSimone said. "I think to date the stock performed well. The company's performed well. But it's something that we talk about frequently, and I'll leave it to the lawyers."
The Ackman-Herbalife crusade has been ongoing for about 18 months now, but it had taken Herbalife some time before they spurned into action.
DeSimone said it was "interesting" to think of Ackman as his adversary. He said his tactics to attack Herbalife are frustrating.
DeSimone said an example of Ackman's poor strategy was his claim that he spent US$50 million to investigate Herbalife's operations. Instead, he said that the money was spent to hire consultants to find people who complain, make videos and get other data to show a lack of transparency.
Herbalife released a public report today showcasing the research done by an FTC economist, who reportedly shows the social and economic benefits of Herbalife.
