Tracy Morgan is going through very difficult times.

The "30 Rock" star's lawyer, Benedict Morelli, shared that the actor is still struggling to get better after an accident in the New Jersey turnpike left him in a critical condition.

Morelli appeared on the "Today Show" on behalf of the actor.

Morgan is also still coping with the loss of his friend James McNair, who died in the accident.

McNair, fondly referred to by Morgan as "Jimmy Mack" was a longtime friend as well as the actor's mentor. 

"He's got the fighting spirit, but every day is different. Some days he's very down," Morelli stated. 

A Walmart tractor-trailer had collided with Morgan's limousine van on June 7 and left him with cracked ribs and a broken leg. Several of the comedian's friends were in the vehicle as well.

To this day, Morelli said that Morgan feels responsible for the accident.

Several news about the comedian's condition have come out, from Morgan dying to his leg getting amputated. Morelli stated that it is a day by day process, but those who assume that he is doing great are wrong. "What is true is he's struggling and he's fighting," he added.

Kevin Roper, the driver of the other vehicle, pleaded not guilty to vehicular homicide and assault.

On the other hand, Wal-Mart continues to cooperate with the investigation and has stated that they will take "full responsibility" if Roper is found guilty.

Morgan and the other survivors have filed a lawsuit against the big chain. Other survivors include his friends, Ardie Fuqua and Jeffrey and Krista Millea.

Last month, photographers caught a glimpse of Morgan with his fiance and baby outside his home. "I'm okay, I feel strong," he said to them.

Before the accident, the diabetic performer had a kidney transplant.
