Colorado Convict Rearrested After Being Freed by Mistake

A convict in Colorado, who was rearrested after being freed 90 years early by mistake, appealed against the ruling, citing that it was a violation of his constitutional rights.

Now 35 years old, Lima-Marin said it was cruel to put him back to jail after he had adjusted to being a free man for almost six years.

In January, a federal judge ordered Rene Lima-Marin to finish his sentence after he was found guilty of kidnapping, burglary, and multiple counts of robbery in 2000.

During his conviction, the judge declared that the 35-year-old Colorado man should serve back-to-back sentences, accumulating to 98 years in jail.

However, the clerk mistakenly indicated in his file the sentences to run at the same time resulting to Lima-Marin being released on parole after being detained for only eight years.

After being released, the convict lived his life normally and avoided the area where he committed the crimes. He had begun to rebuild his life and even started a family with his former girlfriend, Jasmine Lima-Marin.

He acquired a completely legal job as a window fitter and became an active member in church.

"Lima-Marin functioned as a member of society, no different than his neighbors, entirely unaware that Colorado would someday rip him from his home and family and upend a life he took years to build," Lima-Marin's lawyer, Patrick Megaro stated.

However, prosecutors from the Arapahoe County said that the convict was fully aware of the error and never said a word to authorities about it.

They cited that, in an unusual turn of events, he withdrew an appeal for his case in 2001. Prosecutors think that he did so to avoid a review of his case, which may result in authorities finding out about the mistake.

However, Megaro countered that no rational person will insist on "remaining in prison for the rest of their life" by questioning an order for their release.
