China loses trade dispute with U.S. over chicken parts

Geneva - August 2nd, World Trade Organization (WTO) distributed a panel of the Geneva-based trade arbiter to all the member states. The panel supported most of the complaints of U.S. that China had broken global rules by imposing duties on imports of US chicken broiler parts.

According to the WTO disputes settlement panel, China violated WTO rules in the analysis on cost apportionments of dumped imported products, price impact of industrial damage and transparency of verification procedure. The WTO panel said that China's chicken duties were found to have "nullified or impaired benefits accruing to the United States" under international trade accords.
As for the WTO disputes settlement panel, China says they will review the result of judgment carefully, and carry out necessary measures in accordance with legal procedures. If China accepts the result, China must drop the duties within 60 days. If not, China can lodge an appeal.
September 27th, 2009, Chinese Ministry of Commerce issued a notice of initiation that they would investigate some U.S. companies on dumping chicken broiler parts in China. In 2010, China started to carry out anti-dumping duties on Tyson, Keystone and Pilgrim's Pride ranging from 43.1 percent to 80.5 percent, and a "weighted average" duty of 64.5 percent on imports from 32 additional U.S. companies.
September 20th, 2011, the U.S. filed its WTO complaint against China's tariffs on U.S. poultry producers.
