‘Making a Murderer’ Update: Strickland Standard, Brendan Dassey’s ‘Biggest Hurdle’ Yet?

While Brendan Dassey has been optimistic about getting a new trial after being in prison for 11 years now, a recent report on "Making a Murderer" claimed that the Strickland Standard may just be his "biggest hurdle" yet.
As reported by Bustle, Missouri law professor Peter Joy revealed that it is not likely for Dassey, who was only 16 years old when he admitted that he was involved with the murder of photographer Teresa Halbach in 2005, to get a new trial.

In a blog post on Washington University in the St. Louis School of Law website, the lawyer reportedly pointed out that "proving that [his] legal counsel was ineffective is impossibly high."
"In establishing the Strickland standard, the Court created conditions in which unequal assistance of counsel can thrive with little or no recourse for those adversely affected," Peter Joy noted about the latest update on "Making a Murderer," also a web television series by Netflix.
It was further stated that "As a result of the Strickland standard, only the most outrageous conduct by defense counsel leads to a new trial."
As explained by the report, the Strickland Standard talks about the Sixth Amendment "right to a defense attorney - or public defendant - and when that right is violated by the counsel's lacking defense."
Meanwhile, apart from directly discussing about the "Making a Murderer" update, Peter Joy reportedly tackled as well the alleged "unequal access to an efficient legal team."
"There is now, and has always been, a double standard when it comes to the criminal justice system in the United States," the lawyer reportedly said. "The system is stacked against you if you are a person of color or are poor."
