Court Rules Against Sperm Donor's Family Appeal

An appeal from the family of a man who died after donating sperm in 2011 was rejected by a court ruling, reported Changjiang Daily.
The man identified Zheng, was a physician of an unnamed hospital located in China city’s central. He agreed to be a subject during the trial operations of a university sperm bank prior its opening. Zheng signed an agreement to have his health checked every six months during his donation period. His first health check started in January 2011. Zheng was cleared and was given a go signal to donate.

After being declared fit to donate, Zheng donated four times within a period of eleven days. However, after his fifth donation, Zheng was unable to come out from the room where the process is done. The staff of the sperm bank discovered Zheng lying unconscious after almost two hours he first came in the donation room.
Paramedics tried to revive Zheng but he was later declared dead at the scene of the incident.
At the time, Zheng was enrolled for a doctoral degree in the university after completing his master’s in surgery in 2008. The school, the sperm bank and the affiliate hospital agreed to shoulder his burial expenses including paying Zheng’s parents compensation. However, his parents were infuriated with the 88,000 yuan compensation and sued the institutions demanding higher damages for their son’s demise.
Zheng’s parents believed that it would be just fair to demand 4 million yuan for their loss. A statement issued by his family said the university should be held liable after campaigning for sperm donation. Furthermore, they said Zheng’s death was mishandled and that rules had been violated.
However, the court ruling did not favor the appeal of Zheng’s family. The first court said Zheng’s act was voluntary and that he was knowledgeable of his own decisions. This absolved the three institutions held responsible for his death.
