EX-EXO-M Court Case: Luhan Accuses SM Entertainment of Embezzlement; Korean Netizens Call Him Ungrateful

Ex-EXO Luhan's legal reps. reportedly accused SM Entertainment of not paying their client properly and never bothering to hand over a compensation statement. The legal representatives of both parties met on Wednesday, Aug. 19, for the first court hearing on the contract nullification lawsuit filed by Luhan against SM Entertainment.

"The lawsuit was filed due to an unfair contract. We also filed an additional suit for SM's embezzlement and professional negligence," Luhan legal reps. said in the court, according to Soompi.  

They argued that Luhan never received proper documents related to his payment despite repeated request for the compensation statement, and thus, he does not know whether he was paid the right due amount or not. They also claimed that Luhan was just paid 10 million won (approx. 8,400 USD) for the non-stop work he did as part of EXO--music, promotional activities, and appearances on television, according to Soompi.   

SM Entertainment's legal team argued that when Luhan signed the contract, he knew about his earnings. Soompi quoted them as saying, "And Luhan knew that he hadn't been able to yield benefits in the company yet, and his income wasn't something that was important to him at the time."

Luhan quit EXO last year in October and filed a lawsuit against SM Entertainment in the Seoul Central District Court, seeking termination of his exclusive contract. Before their first court date, both parties had failed to reach a settlement on the dispute. In the court on Wednesday, the head judge reportedly noted that SM Entertainment was seeking an amicable resolution. The their legal reps. agreed, but Luhan's side said they are not sure what the management agency means by amicable resolution.

Both parties have ageed to the judge's proposal to hold another mediation. The date for this has been set on Sept. 14.   

Korean Netizens were quick to react on the first court hearing, calling Luhan ungrateful and reminding him about the training cost. Korea Boo quoted one of them as saying, "You disgust me~compensate SM for all the education and training fee they spent on you than sue them." One Korean poster asked him to stay in China and never ever enter Korea, while another asked, "You made 540 Million won in 2 years with EXO and you think this is too little?"

Meanwhile, in July, SM Entertainment filed a lawsuit against Luhan in a Beijing court, saying that the exclusive contract is still valid as the Seoul court has yet to give its ruling, and thus, the Chinese singer-actor cannot sign on solo activities that result in financial loss to the management agency.
