Kesha's Claims Against Dr. Luke Dismissed by New York Judge

(Photo : Getty Images) A New York state judge has tossed out Kesha's claims that she should be released from her Sony contract with Dr. Luke after she was allegedly sexually abused by the music producer.
Kesha has suffered a major setback in her legal battle against Dr. Luke. On Wednesday, a New York judge dismissed Kesha's sexual assault lawsuit against Sony music and the music producer Dr. Luke, whose real name is Lukasz Gottwald.
Kesha filed a lawsuit in 2014, alleging that Dr. Luke drugged and abused her sexually, physically and emotionally for nearly a decade, to the point that she contemplated suicide.

The TiK ToK singer's request for an injunction that allowed her to record music outside of her Sony contract with Dr. Luke was denied by a judge in February, a decision she filed an appeal against in the New York Supreme Court last month.
Supreme Court Justice Shirley Werner Kornreich said on Wednesday that there was no evidence to support that the alleged assault took place in New York and therefore the claims were outside the jurisdiction of the court.
Kornreich also stated that Kesha failed to prove that the alleged abuse was a gender-motivated hate crime.
"Although Gottwald's alleged actions were directed to Kesha, who is female, (her claims) do not allege that Gottwald harbored animus toward women or was motivated by gender animus when he allegedly behaved violently toward Kesha," Kornreich said before noting that the statute of limitations on Kesha's claims had expired. "Her claims of insults about her value as an artist, her looks and her weight are insufficient to constitute extreme, outrageous conduct intolerable in civilized society."
Dr. Luke has denied Kesha's allegations from the outset and even filed a countersuit against the singer, accusing her of defamation and breach of contract. The defendant claims that the singer's allegations are nothing more than an attempt to renegotiate for a better contract.
