Indianapolis Colts Linebacker Josh McNary Taken in for Rape Charges

Josh McNary, a linebacker for the National Football League's (NFL) Indianapolis Colts, was taken into police custody on rape charges according to court documents filed Wednesday by the Marion County prosecutor.

The 26-year old player who has been with the team since 2013 currently faces one count of rape along with another count of criminal confinement and one count of battery.

He was taken into police custody last Wednesday after the charges were filed.

A 29-year old woman told police that a man she met Downtown took her out for drinks and, took her to his apartment, and then raped her.

A probable cause affidavit stated that the two ended up in a bedroom and the man tried to kiss her face and neck. After she turned down his advances, the man became aggressive. She said he scared and intimidated her.

After scratching the man in the neck, face, back, and shoulder before the rape, she later sneaked out of the apartment when the man was in the bathroom. She was able to take the man's cellphone as she couldn't find her own.

The incident happened in the early morning hours of December 1.

When police traced back the phone, it led to McNary. A search warrant was obtained for his apartment.

When the police came, McNary said he knew why the police were there. He pointed to the pile of bedding and said that he preserved it because he knew they would be coming.

After being interviewed, McNary was read his rights and taken to a hospital where a suspect sexual assault examination was performed.

The results of the test have not yet been released.

The Colts released a statement saying that they are aware of the report about McNary. However, they say that there is a limit to their current knowledge.

"At this time, we are very concerned and trying to find out what the relevant facts are, but we have insufficient information to venture any opinion. As we learn more, we will make appropriate updates."
