G. W. "Bud" McCoig, Jefferson County Sheriff, told People that Dyer refused to let the boy see her puppy. The boy was said to have gone back to his house, where he took his father's shotgun. After which, he went to the Dyers' and fired the gun at McKayla through a window. Responders tried to revive the little girl, who was pronounced dead by physicians upon her arrival at the hospital.

The 11-year-old has been charged with first-degree murder in the girl's death, McCoig said. He added that prosecutors are still in the process of discussing the possibility. The boy is scheduled to appear in court on October 28. A judge ruled that until then, he should remain under police custody. The boy's attorney, Ed Miller, has not returned a message sent to him on Monday.

McKayla Dyer is the boy's school mate at White Pine Elementary School, according to a report from Mirror UK. McKayla's mother, Latasha, said that the boy has been bullying her daughter. "He was making fun of her, calling her names, just being mean to her." Ms. Dyer added that she went to the principal to get the boy to stop bullying her daughter. "He did quit for a while, and then all of a sudden, yesterday he shot her."

Ms. Dyer spoke to WATE-TV about McKayla, calling her "a precious little girl and a mommy's girl". McKayla died on Saturday afternoon.
